BrantJobs Website Terms of Use


BrantJobs Service

BrantJobs is a service provided free of charge by the City of Brantford [the “City”] and the County of Brant [the “County”] for Job Seekers and Employers located within the City and County. Users who access and register on the Website (www.brantjobs.ca), agree to the Terms of Use and Privacy Policy as outlined.

Information that is submitted by both Job Seekers and Employers who register on the Website, such information as resumes, cover letters, field of interest, experience and education and employer information regarding wages, user location, industry type, company size, and etc. are providing such information to BrantJobs staff. All information submitted will be used by BrantJobs staff to evaluate and enhance the services provided on the Website and to generate local Labour Market Reports.

1. Ter ms

By accessing this Website you are agreeing to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree with any of the below Terms of Use, do not use this Website. The City reserves the right to revise any part of these Terms of Use at any time and you agree to be bound by such revisions and changes.

2. Use Licence

Permission is granted by the City to access, use and view the Website for personal, non-commercial use only. This is the grant of a licence not a transfer of title and under the licence you may not:

  1. modify or copy the materials for any and all commercial use;
  2. use the materials for any commercial purpose or for any public display;
  3. attempt to decompile or reverse engineer any software and code contained on BrantJobs Website;
  4. remove any copy right or other proprietary notations from the material; and
  5. transfer the materials to another person or “mirror” the materials on any other server.

3. Permitted and Prohibited Uses

The Website may be used only for lawful purposes by individuals seeking employment and career information, and by employers seeking employees and labour market information. You agree to use the Website only to send messages, information, data, text, images or other materials and receive downloaded messages, information, data, text, images or other materials from the Website that are proper and related to the purpose of the Website.

You may only post materials to the Website for the lawful stated of purposes of the Website and only postings which seek an employer/employee relationship within the meaning of the Income Tax Act (Canada) will be accepted. However, the City will have the discretion to refuse any posting in its absolute discretion. The City reserves the right at all times to disclose any material that in the City’s sole discretion is objectionable or in violation of these Terms of Use.

4. Registration and Password

  2. Trademarks. The service names, company names and logos used on this Website may be trademarks, including registered trademarks of the City. Service names, company names and logos of the City may not be copied, imitated or used, in whole or in part, without the prior written consent of the City. Other services and company names mentioned on this Website may be the trademarks of their respective owners.
  3. Reservation of Rights. The City services, methods and processes may be covered by one or more patents or other intellectual property rights, and are subject to trade secret and other proprietary rights. The City reserves all such rights.
  4. Software. Any software, as well any files or images generated by such software, code and data accompanying such software (the “Software”), used or accessible through this Website is the copyrighted work of the City or its licensors. Unless provided for elsewhere, you are licensed to use the Software on a non-exclusive basis for the purposes expressly stated on this Website. Except as permitted by law, you may not use the Software for any other purpose or attempt to decipher, decompile, disassemble or reverse engineer any of the Software comprising or in any way making up a part of the Website.

6. Linking Agreement

The City welcomes links to its Website. If you want to link to this Website, the City grants you a limited, non-exclusive, non-transferable, royalty-free license to use the City’s trademarks and internet icons, if available, solely for the purpose of serving as a link from your website to this Website.

In addition, you must comply with the following conditions:

  1. A link may only be established to the home page of this site: http://www.brantjobs.ca, unless permitted differently as outlined in Section 7 (Content Mirroring Agreement).
  2. You acknowledge that all rights to the trademarks and internet icons, if available, and all content appearing on the Website pages belong to the City and you will not at any time contest or infringe these rights.
  3. Your web site shall not:

    1. alter the visual presentation of the City’s Website;
    2. imply that the City is endorsing you or your products or services;
    3. imply an affiliation between your company and the City;
    4. may not misrepresent your relationship with the City or present false or misleading impressions about the City’s Website services, and
    5. contain materials that may be interpreted as distasteful or offensive and should be appropriate for all age groups.
  4. The City shall have no responsibility or liability for any content appearing on your website.
  5. The City may at any time, in its sole discretion immediately terminate your license to use the trademarks and internet icons and your right to link to this Website, with or without cause. If the City exercised this right, you will immediately remove all links to the Website and cease using the trademarks and Internet icons.

Certain links on this Website may take you to other websites. The City provides these links only as a convenience. Following such links is entirely at the risk of the user and the City makes no representation or warranty as to the accuracy or completeness of any information obtained from any such link.

7. Content Mirroring Agreement

Mirroring content and job ads on external sites are permitted subject to the strict adherence of the following criteria.

  1. Prior permission is obtained in writing from an authorized manager representing the Website.
  2. No fees will be charged to access content used from this Website.
  3. All content including graphics and logos are subject to Section 5 (Proprietary Rights) of these Terms of Use.
  4. When job ads are mirrored, every active job on this Website must be made accessible to all users of the hosted website in identical formats without the elevation of one posting over another.
  5. When original content is removed from the Website, identical content must be removed from the mirrored host within 24 hours.
  6. Content must be displayed in its entirety and must remain unedited (website links should be in clickable hyperlinked format). Minor formatting changes are permitted for aesthetic purposes provided the text remains readable and accessible.
  7. A hyperlink to the original page on the Website must appear with the wording "Source: BrantJobs" and must immediately precede and proceed the content.

The City makes no representation or warranty of any kind regarding the Website and/or content of material including the accuracy or completeness of any information contained on the Website. The City does not warrant that this Website will continue to operate, operate without interruptions or that it will be error free.

This Website acts as a venue for Employers to post job opportunities and Job Seekers to research and evaluate job opportunities for themselves. The City is not involved in the actual transaction between Employers and Job Seekers.

As a result the City has no control over the quality, safety or legality of the jobs or profiles posted, the truth or accuracy of the listings, the ability of Employers to offer job opportunities to Job Seekers or the ability of Job Seekers to fill job openings. You assume all risks associated with dealing with other users with whom you come in contact through the Website.

10. Limitation of Liability

You agree that the City and any third party mentioned on this Website will not be responsible or liable for any loss or damages whatsoever, including without limitation indirect, special or consequential damages or other damages (including without limited damages for harm to business, loss of information or programs or date, loss of savings, loss of revenue), arising from or in connection with the use of or access to, or the inability to use or access, this Website, the materials, any content provided or any linked Website of third party, even if the City, or such a third party has been advised of the possibility of such damage or loss. In any event, you agree that the City’s aggregate liability for damages shall be limited to $100.

The limitations of liability and disclaimers in these Terms of Use apply regardless of the form of action, whether in contract, warranty, civil liability, strict liability, negligence, or other tort and shall survive a fundamental breach or breaches, or the failure of the essential purpose of contract or the failure of an exclusive remedy.

13. Specific Terms of Use for Employers

  1. The City will not permit an Employer located outside the City or County to post for positions of employment located outside the City or County.
  2. All Employers must certify that, even if the position is a commission position, a position which pays on a piece work basis, or otherwise uses a non-standard means of compensation, the statutory minimum wage will be paid.
  3. Only postings which seek an Employer/Employee relationship within the meaning of the Income Tax Act (Canada) will be accepted, but the City will have the discretion to refuse any posting in its absolute discretion. In addition, independent distributorships, relationship marketing, multi-level marketing systems or other similar types of engagement will not be accepted.
  4. If requested by the City, Employers will provide to the City their Business Number for payroll accounts, and other identifying numbers such as GST Registration number that may be requested by the City.
  5. Postings must relate to a current vacancy. Employers may not post positions to build up a stock of resumes, to test the labour market, or for any other purposes than to solicit applications for a current vacancy.
  6. Employers who disregard these rules may be barred from the posting of further jobs on the Website in the City’s sole discretion.
  7. By using this Website Employers will have agreed to cooperate with City staff to provide follow-up information to the City to assist it to operate the Website.
  8. No posting may contravene any by-law of the City or any Federal or Provincial legislation.

14. Specific Terms of Use for Job Seekers

  1. Job Seekers are solely responsible for any information that is submitted and they agree to submit information about themselves that is true, accurate and current.
  2. Job Seekers will not submit any sensitive or personal information such as age, social insurance number, financial or medical information or any such information relating to other people, with the exception of the information contained within a Job Seekers resume, cover letter or registration.
  3. Job Seekers will not create an account containing inappropriate information, such as material that is obscene, defamatory, threatening, harassing, abusive, hateful, or embarrassing to others.
